These Terms & Conditions (“Terms”) govern your membership, participation, and use of services offered by Lone Star Pickleball Club (“we,” “us,” or “our”). By accessing our facilities, participating in events, or engaging with our services, you agree to abide by these Terms. Please read them carefully.
1. Introduction
Welcome to Lone Star Pickleball Club. These Terms form a binding agreement between you and the Club regarding your membership, participation in activities, and use of our services. By enrolling, booking courts, attending events, or using our facilities, you confirm your understanding and acceptance of these Terms.
2. Definitions
“Club” refers to Lone Star Pickleball Club, including its staff, affiliates, and representatives.
“Member” refers to any individual enrolled in a membership program.
“Services” include, but are not limited to, memberships, tournaments, clinics, social events, facility access, and equipment usage.
“Facilities” refer to all courts, buildings, and amenities operated by the Club.
“You” or “your” refers to any person accessing or using the Club’s services, whether a member, guest, or participant.
3. Use of Services
Eligibility: You must be at least 18 years old and legally able to enter a binding agreement to use our Services. Minors may participate with parental consent and supervision, subject to club policies.
Registration and Scheduling: Memberships, event registrations, and court reservations must be made through our office, website, or designated platforms. You are responsible for providing accurate, up-to-date contact and registration information.
Facility Access and Cooperation: You agree to follow club rules, provide safe access to courts and facilities, and inform us of any hazards or special conditions (e.g., medical concerns) before participating in activities.
4. Member and Club Property
Member Property: You are responsible for securing personal belongings and ensuring the playing area is clear of obstacles. We are not liable for lost or damaged personal items unless directly caused by our negligence.
Club Equipment and Facilities: Any equipment, courts, or materials provided by Lone Star Pickleball Club remain our property and may not be removed, tampered with, or misused.
5. Payments
All membership fees, event registration costs, court reservation fees, or other charges will be communicated before participation. Payment is due at the time of registration or service unless otherwise agreed in writing.
All payments are non-refundable except where required by law or specified in membership or event agreements.
6. Scheduling and Cancellation
Court reservations, event registrations, or clinic bookings may be canceled or rescheduled with at least 48 hours’ notice. Failure to do so may result in a cancellation fee or loss of reservation privileges.
Repeated no-shows may lead to restrictions on future bookings or membership suspension.
7. Limitations and Exclusions
We are not responsible for:
Pre-existing injuries or health conditions not disclosed prior to participation.
Damage to personal equipment caused by normal wear and tear, misuse, or external factors.
Issues arising from failure to follow club rules or staff instructions.
8. Prohibited Use
You agree not to:
Use our facilities or services for illegal or unsafe purposes.
Tamper with club equipment, courts, or facilities.
Endanger staff, members, or guests, or obstruct their ability to participate safely.
9. Limitation of Liability
To the fullest extent permitted by law, Lone Star Pickleball Club shall not be liable for indirect, incidental, or consequential damages, including lost opportunities or injuries not directly caused by our negligence. Our total liability is limited to the amount you paid for the service or membership in question within the past 12 months.
10. Indemnification
You agree to indemnify and hold harmless Lone Star Pickleball Club, its employees, and affiliates against any claims or damages arising from your use of our Services, your violation of these Terms, or any harm occurring during your participation in club activities.
11. Warranty and Maintenance
We offer limited warranties on purchased equipment, subject to manufacturer terms.
Warranty coverage does not apply to equipment damaged due to misuse, improper care, or unauthorized modifications.
Regular maintenance of personal equipment is recommended to ensure safety and performance.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas. Any disputes will be resolved through binding arbitration in Tarrant County, TX. You waive the right to a jury trial.
13. Modifications to Terms
We may update these Terms from time to time. Changes will be posted on our website or provided directly. Continued use of our Services after changes implies acceptance.
14. Entire Agreement
These Terms constitute the full agreement between you and Lone Star Pickleball Club. If any provision is found invalid, the remainder will remain in effect.
